> LoRA adapter、合并权重、GGUF 量化文件及一切再分发形态。以下统称「本模型 / the Model」。

## 第一条 授权范围（学习与研究免费）
## Article 1 Grant of Rights (Free for Learning & Research)
在遵守本许可全部条款的前提下，权利人**免费授予**任何人为**学习、教学、学术研究、个人非商业实验、非营利性公益用途**之目的，在全球范围内使用、复制、修改本模型及制作衍生作品的非独占权利。鼓励在论文、课程、技术分享中引用与复现，引用请注明出处（见第六条）。
Subject to full compliance with this License, the Licensor grants you, free of charge, a non-exclusive, worldwide right to use, reproduce, modify and create derivative works of the Model **for learning, teaching, academic research, personal non-commercial experimentation, and non-profit public-welfare purposes**. Citation and reproduction in papers, courses and technical sharing are encouraged, with attribution (see Article 6).
## 第二条 商业使用须事先授权（核心限制）
## Article 2 Commercial Use Requires Prior Authorization (Core Restriction)
**任何商业性使用，必须事先取得权利人的书面授权（商业许可协议）。** 未获授权，不得将本模型或其任何衍生物直接或间接用于商业目的，包括但不限于：
- 在收费/营利的产品、服务、SaaS、API 中部署或调用本模型；
- 以本模型提供面向第三方的付费诊疗辅助、咨询、内容生成等服务；
- 将本模型或其衍生权重出售、出租、再许可或捆绑销售；
- 任何为组织带来直接或间接经济利益的生产环境使用。
**Any commercial use requires the Licensor's prior written authorization (a commercial license agreement).** Without such authorization, you may not use the Model or any of its derivatives, directly or indirectly, for commercial purposes, including but not limited to: deployment in paid/for-profit products, services, SaaS or APIs; providing paid diagnosis-assistance, consulting or content-generation services to third parties; selling, renting, sublicensing or bundling the Model or its derivative weights; or any production use bringing direct or indirect economic benefit to an organization.
## 第三条 全球南方与"一带一路"优惠条款
## Article 3 Preferential Terms for the Global South and Belt & Road Partners
权利人秉持**技术普惠**原则，对以下主体申请商业授权时给予**费用减免优惠**（折扣直至全额免除，个案审定），并在同等条件下提供优先技术支持：
1. **全球南方国家**：注册地或主要服务地位于世界银行低收入、中低收入或中高收入经济体名单内的机构；
2. **"一带一路"共建国家**：与中国签订共建"一带一路"合作文件的国家/地区的机构；
3. 上述区域内从事**基层医疗、公共卫生、医学教育**等公益属性业务的机构，可申请**完全免费的公益商业许可**。
申请时须提供注册地证明与用途说明。优惠条款不影响本许可其他条款（特别是第四条医疗安全条款）的适用。
Guided by the principle of **technology inclusiveness**, the Licensor offers **fee reductions or waivers (case-by-case, up to a full waiver)** for commercial licensing, together with priority technical support under equal conditions, to:
1. **Global South countries**: organizations registered in, or primarily serving, economies listed by the World Bank as low-income, lower-middle-income or upper-middle-income;
2. **Belt & Road partner countries**: organizations in countries/regions that have signed Belt & Road cooperation documents with China;
3. Organizations in the above regions engaged in **primary healthcare, public health or medical education**, which may apply for a **fully free public-welfare commercial license**.
Proof of registration and a statement of purpose are required. These preferential terms do not affect the applicability of any other provisions of this License (in particular Article 4 on medical safety).
## 第四条 医疗免责与定位（务必知悉）
## Article 4 Medical Disclaimer & Intended Use (Mandatory Reading)
本模型是**临床决策支持与教育辅助工具**，**不是医疗器械**，**未经任何药品/医疗器械监管机构（NMPA、FDA、EMA 等）审批**。其输出为参考性建议，**必须由具备资质的执业医师复核后方可用于任何诊疗决策**。
- 严禁将本模型用于**自主诊断、自动开具处方、替代医师判断**或任何无人复核的临床自动化；
- 模型可能产生错误、过时或不安全的内容；使用者须自行承担使用本模型的一切风险与后果；
- 涉及真实患者的任何使用，须另行满足所在地数据合规（隐私/知情同意）与医疗法规要求。
The Model is a **clinical decision-support and educational aid**. It is **not a medical device** and has **not been approved by any drug/medical-device regulator (NMPA, FDA, EMA, etc.)**. Its outputs are reference suggestions only and **must be reviewed by a licensed physician before any clinical decision**.
- Using the Model for **autonomous diagnosis, automatic prescription, substitution of physician judgment**, or any unreviewed clinical automation is strictly prohibited;
- The Model may produce erroneous, outdated or unsafe content; you bear all risks and consequences of use;
- Any use involving real patients must separately satisfy local data-compliance (privacy/informed consent) and medical regulations.
## 第五条 上游许可（须一并遵守）
## Article 5 Upstream Licenses (Must Be Observed Together)
本模型为以下开源底座的微调衍生物，使用与再分发须同时保留并遵守各上游许可：
- **DeepSeek-R1-Distill-Qwen 系 / Qwen2.5 / Qwen3 系**：Apache License 2.0（保留版权与许可声明）；
- **THUDM/GLM-4 系**：智谱 GLM-4 模型许可（见其官方仓库）；
- 训练数据为公开学术基准与自建知识库，**全程无任何患者 PII**；上游考题版权灰区已在发布论文 §2.3 如实披露。
如本许可与上游许可冲突，**以上游许可中更严格者为准**。
The Model is a fine-tuned derivative of open-weight base models; use and redistribution must preserve and comply with the upstream licenses:
- **DeepSeek-R1-Distill-Qwen series / Qwen2.5 / Qwen3 series**: Apache License 2.0 (copyright and license notices must be retained);
- **THUDM/GLM-4 series**: the GLM-4 model license (see its official repository);
- Training data consists of public academic benchmarks and self-built knowledge bases, **entirely free of patient PII**; the copyright gray zone of upstream exam questions is disclosed in §2.3 of the accompanying paper.
In case of conflict between this License and an upstream license, **the stricter terms of the upstream license shall prevail**.
## 第六条 再分发与署名
## Article 6 Redistribution & Attribution
再分发本模型或其衍生物时，必须：
1. 附带本许可全文（中英双语）；
2. 保留署名「jinsixian-tcm · 伊妹智能门诊 AIMate」及原始仓库/官网链接；
3. 明确标注所做的修改；
4. 以相同条件（学习研究免费、商业须授权）向下游传递，不得施加额外限制。
When redistributing the Model or its derivatives, you must: (1) include the full text of this License (bilingual); (2) retain the attribution "jinsixian-tcm · AIMate" and the original repository/website link; (3) clearly mark any modifications; (4) pass along the same conditions (free for learning & research; commercial use requires authorization) without imposing additional restrictions.
## 第七条 违约与终止
## Article 7 Breach & Termination
违反本许可任何条款的，依据本许可获得的权利**自动终止**；情节严重的，权利人保留追究法律责任的权利。终止后，已依第三条获得的优惠商业许可不受影响，除非违约行为涉及该许可本身。
Any breach of this License automatically terminates the rights granted hereunder; the Licensor reserves the right to pursue legal remedies for serious breaches. Preferential commercial licenses duly obtained under Article 3 shall survive termination unless the breach concerns such license itself.
## 第八条 免责声明（AS-IS）
## Article 8 Disclaimer (AS-IS)
本模型按「现状」提供，不附带任何明示或默示担保（包括但不限于适销性、特定用途适用性、准确性、安全性、不侵权）。在适用法律允许的最大范围内，权利人不对任何使用本模型所致的直接、间接、偶然、特殊或后果性损害承担责任。
THE MODEL IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, SAFETY AND NON-INFRINGEMENT). TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM ANY USE OF THE MODEL.
